1. Provider

These Terms govern your use of themillionfaces.com (the "Service"), operated by Peter Uphaus, Holtkampweg 58, 45721 Haltern am See, Germany (p.uphaus@gmx.de), hereinafter "Provider", "we".

2. The Service

The Million Faces is a digital, permanent mosaic of up to 1,000,000 pixels. Users ("Participants") can purchase one or more pixels and assign a personal selfie to each pixel. Each purchased pixel grants a non-exclusive, perpetual, worldwide right to have the assigned image publicly displayed at that position within the mosaic, subject to these Terms.

3. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) and able to enter into a binding contract.

4. Account & accuracy

You are responsible for keeping your login credentials secret and your account information accurate. We may suspend accounts that violate these Terms.

5. Conclusion of contract & price

Pixels are offered for the price displayed at checkout (currently USD 1 per pixel, plus any applicable taxes). The contract is concluded when we confirm your order by email. Prices on the Service are gross prices for consumers in the EU; outside the EU local taxes may apply.

6. Payment

Payment is due immediately via the available payment methods. Your pixel is reserved upon successful payment.

7. Content rules

You may only upload images that (a) you have the right to publish, (b) show you yourself or a person who has explicitly consented, and (c) do not violate any laws. Forbidden content includes, without limitation:

• nudity, sexual or pornographic content;
• violence, hate speech, discrimination, extremist symbols;
• logos, brand marks, QR codes, or commercial advertising;
• images of third parties without consent;
• content that infringes copyright, trademarks, or personality rights;
• content that is illegal under German or EU law.

We reserve the right to refuse, remove, or replace non-compliant images without refund. Repeated violations may lead to account termination.

8. Licence you grant us

By uploading an image you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to host, display, scale, compress, and reproduce the image as part of the mosaic and in promotional material related to the project (e.g., screenshots, social previews, press coverage).

9. Availability

We aim for high availability but do not guarantee uninterrupted operation. Planned maintenance, force majeure, or technical issues may cause downtime.

10. Liability

We are liable without limitation for intent and gross negligence and for damages resulting from injury to life, body, or health. For slight negligence we are only liable for breach of material contractual obligations, limited to the foreseeable damage typical of the contract. Liability under the German Product Liability Act remains unaffected.

12. Dispute resolution

The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Governing law

These Terms are governed by German law. For consumers, mandatory consumer protection provisions of their country of residence remain unaffected.

14. Changes

We may amend these Terms with reasonable notice. Continued use after the effective date constitutes acceptance.
